By accessing or using qualitynativecigs.ca (the “Site”), you agree to these Terms of Service. If you do not agree, please do not use the Site.
1. Eligibility & Age Requirement
You must be of legal smoking age in your province (18 in most provinces, 19 in BC, NB, NS, NL, NT, NU, ON, PEI, SK, YT, and 21 in some areas) to purchase tobacco products. By placing an order you represent that you meet this age requirement and confirm acceptance via our age-verification gate.
2. Indigenous Reserve Sales & Tax Exemption
Quality Native operates from a recognized Indigenous reserve. Pursuant to Section 87 of the Indian Act and the related Excise Tax Act provisions, products sold from the reserve to qualifying purchasers are exempt from federal and provincial sales taxes (GST, HST, PST, QST). All prices shown are tax-exempt and tax-inclusive at $0.00.
Customers are responsible for compliance with their own provincial possession and import limits.
3. Products & Pricing
- All prices are listed in Canadian Dollars (CAD).
- We reserve the right to change prices, modify product offerings, and limit order quantities at any time.
- Product images are for reference; actual packaging may vary.
4. Payment
We accept payment exclusively via Interac e-Transfer (EMT) to sweetcornsvaritey26@yahoo.com. Orders are reserved for 48 hours pending payment. Unpaid orders after this period may be cancelled automatically.
5. Shipping
Refer to our Shipping Policy for delivery times, carriers, and free-shipping thresholds.
6. Damaged Packages
We do not offer cash refunds. If your package arrives damaged, see our Damaged Package Replacement policy for our reshipment process.
7. Lucky Spin Rewards
Lucky Spin prizes (discounts, free shipping, gifts) are non-transferable, have no cash value, and may be revoked in cases of abuse or fraud. One reward per order unless otherwise stated.
8. User Accounts
You are responsible for maintaining the security of your password. Notify us immediately of any unauthorized use. We may suspend accounts engaged in fraud, chargebacks, or violation of these terms.
9. Reviews & User Content
By posting reviews you grant us a non-exclusive, royalty-free license to display, edit for length, and re-publish the content. We may remove reviews that contain offensive, false, or unrelated material.
10. Disclaimers
WARNING: Tobacco products contain nicotine, an addictive chemical. Smoking is harmful to your health. The Site is provided “as is” without warranties of any kind. We do not guarantee uninterrupted availability.
11. Limitation of Liability
To the maximum extent permitted by law, Quality Native's liability for any claim arising from your use of the Site or our products is limited to the amount you paid for the order in question.
12. Governing Law
These Terms are governed by the laws of the Province of Ontario and applicable federal laws of Canada and laws recognized within the Indigenous reserve from which we operate. Disputes shall be resolved in the courts of Ontario.
13. Changes
We may update these Terms at any time. Continued use of the Site constitutes acceptance of the updated terms.
